Terms of Service
Evizion Media Group
Effective Date: October 27, 2026
Last Updated: October 27, 2026
1. Agreement to These Terms
These Terms of Service ("Terms") are a legal agreement between you and The Moreland Group LLC, doing business as Evizion Media Group ("Evizion Media Group," "EMG," "we," "us," or "our"). They apply to your use of evizionmediagroup.com, TrueQuotes (truequotes.io), and any other websites, landing pages, forms, phone lines, text messages, and online services that link to these Terms (together, the "Services").
By using the Services, you agree to these Terms and our Privacy Policy, available at https://evizionmediagroup.com/privacy. If you do not agree, do not use the Services.
PLEASE READ SECTION 14 (DISPUTE RESOLUTION; BINDING ARBITRATION) CAREFULLY. IT REQUIRES YOU TO RESOLVE MOST DISPUTES WITH EMG THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION, WAIVES YOUR RIGHT TO A JURY TRIAL, AND WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, UNLESS YOU OPT OUT WITHIN 30 DAYS AS DESCRIBED IN SECTION 14.
2. Who Can Use the Services
You must be at least 18 years old and able to enter into a binding contract to use the Services. If you use the Services for a business, you confirm you are authorized to accept these Terms on its behalf.
3. What We Do
For consumers (TrueQuotes and similar forms). TrueQuotes is a free quote-comparison and matching service. When you submit a request, we may share your information with buyers, service providers, and marketing partners, including one or more third-party businesses (such as home service companies, contractors, insurance providers, law firms or legal advertising organizations, and providers in other categories) that may contact you about your request.
How we are paid. The Services are free to consumers. EMG is compensated by the buyers and providers that receive consumer requests and by our marketing partners, not by you. This compensation may affect which providers receive your request and the order in which providers are presented. We do not present every provider available in your area.
For businesses (evizionmediagroup.com). We offer local-business marketing, search engine optimization (SEO), marketing automation, and lead generation services, including SMS/text follow-up, missed-call text-back, review automation, and CRM tools. Specific services, fees, and deliverables for business customers are described in a separate proposal, order form, or service agreement, which controls if it conflicts with these Terms.
4. Important Disclaimers About Our Role
- We are not a law firm; no legal advice; no attorney-client relationship. EMG is not a law firm and does not provide legal advice. Information on the Services is general information only and is not legal advice. Submitting a form, calling, or otherwise communicating with EMG does not create an attorney-client relationship with EMG or with any attorney, and information you send before an attorney agrees to represent you may not be confidential or privileged. Any attorney you are connected with is independent and solely responsible for their own services, and the decision to hire an attorney is an important one that should not be based solely on advertisements.
- Attorney advertising. Some content on the Services relating to legal matters may be considered attorney advertising. Prior results do not guarantee a similar outcome.
- Not a lawyer referral service. Unless we expressly state otherwise in writing, EMG is not a licensed, certified, or bar-approved attorney or lawyer referral service, and EMG does not recommend, endorse, or vouch for any particular attorney.
- We are not a contractor or insurer. EMG does not perform home services, construction, repairs, or installations, and does not sell, quote, bind, or underwrite insurance or give insurance advice. EMG does not act as your contractor, insurance agent, or insurer.
- No endorsement; third-party providers are independent. Businesses you are matched with are independent third parties, not EMG employees or agents. We do not endorse, recommend, guarantee, or verify any provider's licenses, insurance, qualifications, pricing, availability, or work quality, unless we say so in writing. You are responsible for checking a provider before hiring them. Any agreement you make is solely between you and that provider, and EMG is not responsible for any provider's acts or omissions.
- No guarantee of match or quote. We do not guarantee that any provider will contact you, offer a quote, or offer a particular price or outcome.
- No guarantee of results for business customers. Marketing results depend on many factors outside our control, such as search engine algorithms, ad platforms, competition, and your business operations. We do not guarantee any specific rankings, traffic, leads, conversion rates, revenue, or return on investment. Any past results or examples are not a promise of future results.
5. Your Responsibilities
You agree to:
- provide true, accurate, current information, and only submit information about yourself (or someone you are authorized to act for);
- only provide a phone number that you own or are authorized to use, and tell us promptly if that number changes or is reassigned; and
- use the Services only for lawful purposes.
6. Calls and Text Messages
If you give consent on one of our forms, you agree to receive calls and text messages as described in that consent and in our Privacy Policy, which may use automated technology or prerecorded/artificial voice where permitted by law. Consent is not a condition of purchase. To request quotes without consenting to calls or texts, call us at (850) 821-7433. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help, or contact hello@evizionmediagroup.com or (850) 821-7433. Carriers are not liable for delayed or undelivered messages. Calls to and from EMG may be recorded and monitored; by continuing a call after being informed of this, you consent to the recording and monitoring.
7. Business Customers: Messaging and Data Compliance
If you use our SMS follow-up, missed-call text-back, review automation, CRM, or other communication tools, you agree that:
- you are responsible for obtaining and documenting all consents required by law (including the Telephone Consumer Protection Act (TCPA), the Florida Telephone Solicitation Act, CAN-SPAM, and similar state laws) before we send messages on your behalf;
- you will honor opt-outs promptly and maintain do-not-call lists as required;
- you will comply with carrier and platform requirements (such as 10DLC registration rules) and any review platform policies and laws on reviews (for example, not offering incentives conditioned on positive reviews and not selectively soliciting or suppressing reviews where prohibited);
- you will not use the tools to send spam, unlawful, deceptive, or harassing messages; and
- you will indemnify EMG for claims arising from your messages, contact lists, or failure to obtain consent (see Section 12).
We may suspend messaging at any time if we believe it creates legal, carrier, or reputational risk.
8. Acceptable Use
You may not:
- submit false, fake, or fraudulent information, or submit information about another person without authorization;
- use bots, scripts, or automated means to submit forms or scrape the Services;
- interfere with or disrupt the Services, or try to gain unauthorized access to our systems;
- upload viruses or harmful code;
- use the Services to harass, defraud, or harm anyone;
- copy, resell, or exploit the Services except as allowed in these Terms or a written agreement; or
- use the Services in violation of any law.
We may suspend or end your access at any time if you violate these Terms or if we believe your use creates legal or business risk for EMG.
9. Intellectual Property
The Services and their content, including text, graphics, logos, the Evizion Media Group and TrueQuotes names and marks, software, and design, are owned by EMG or its licensors and protected by intellectual property laws. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works without our written permission. Ownership of work product created for business customers is governed by the applicable service agreement.
If you send us feedback or ideas, we may use them without any obligation to you.
10. Third-Party Sites and Services
The Services may link to or rely on third-party websites, tools, and providers. We are not responsible for their content, policies, products, or services. Your use of them is at your own risk and subject to their terms.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, EMG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE SERVICES IS ACCURATE OR COMPLETE. WE MAKE NO WARRANTY ABOUT ANY THIRD-PARTY PROVIDER OR THE GOODS OR SERVICES IT OFFERS.
12. Limitation of Liability and Indemnity
TO THE FULLEST EXTENT ALLOWED BY LAW, EMG AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR ANY THIRD-PARTY PROVIDER, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE TOTAL AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some states do not allow certain limitations or exclusions, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnity. To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless EMG and its owners, members, managers, officers, employees, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees and costs) arising from or related to your use or misuse of the Services, information you submit, your violation of these Terms or the law, your dealings with any third-party provider, or (for business customers) your messages, contact lists, and consent practices. We may control the defense of any matter subject to indemnification, and you will cooperate with us.
13. Governing Law
These Terms, and any dispute arising from or related to them or the Services, are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. The Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of Section 14.
14. Dispute Resolution; Binding Arbitration; Class Action and Jury Waiver
a. Informal resolution first. Before starting arbitration or any other proceeding, you and EMG agree to try to resolve any dispute informally. The party with the dispute must send a written notice describing the dispute, the relief requested, and the sender's name and contact information (for notices to EMG, by email to hello@evizionmediagroup.com, with a copy by mail to the address in Section 17). The parties will try in good faith to resolve the dispute for at least 30 days after the notice is received. Any deadline to file a claim is paused during this 30-day period.
b. Agreement to arbitrate. If the dispute is not resolved within 30 days, you and EMG agree that any dispute, claim, or controversy arising from or relating to these Terms, the Services, our Privacy Policy, any information you submitted, or any calls, text messages, or other communications from or on behalf of EMG (including claims under the Telephone Consumer Protection Act, the Florida Telephone Solicitation Act, and similar laws), whether based in contract, statute, tort, or any other legal theory, will be resolved by final and binding individual arbitration, except as stated in subsection (f).
c. Rules and administrator. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (for individuals using the Services for personal, family, or household purposes) or its Commercial Arbitration Rules (for business customers), and, where applicable, its Mass Arbitration Supplementary Rules, as in effect when the arbitration is filed. The AAA's rules are available at www.adr.org. Payment of filing, administration, and arbitrator fees will be governed by the applicable AAA rules. The arbitrator will apply Florida law and applicable federal law and may award the same individual relief a court could award, but only to the individual party seeking relief and only to the extent needed to resolve that party's individual claim.
d. Location. The seat of the arbitration will be Leon County, Florida. Any in-person hearing will take place in Leon County, Florida, unless the parties agree otherwise or the applicable AAA rules require otherwise. The arbitrator may conduct hearings by telephone or video, or decide the matter on written submissions.
e. Arbitrator's authority. The arbitrator will decide all issues, including the scope, enforceability, and arbitrability of this Section 14, except that a court in Leon County, Florida will decide any dispute about the validity, enforceability, or scope of the class action waiver in subsection (g). The arbitrator's award is final and binding, and judgment on the award may be entered in any court with jurisdiction.
f. Exceptions. Either party may (i) bring an individual claim in small claims court, if the claim qualifies and stays in that court on an individual basis; and (ii) bring a lawsuit in court seeking injunctive or other equitable relief for the alleged infringement or misuse of intellectual property or unauthorized access to or interference with the Services.
g. Class action waiver. YOU AND EMG AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any class, collective, or representative proceeding. If this class action waiver is found unenforceable as to any claim, that claim will be severed and decided by a court in Leon County, Florida, after all individual claims have been arbitrated, and the rest of this Section 14 will remain in effect.
h. Jury trial waiver. TO THE FULLEST EXTENT ALLOWED BY LAW, YOU AND EMG WAIVE ANY RIGHT TO A JURY TRIAL for any dispute arising from or relating to these Terms or the Services, whether in arbitration or in court.
i. 30-day right to opt out. You may opt out of this agreement to arbitrate by sending an email to hello@evizionmediagroup.com with the subject line "Arbitration Opt-Out" within 30 days after you first accept these Terms (for example, by first using the Services or submitting a form). Your email must include your name, mailing address, phone number, and email address, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms, including the exclusive venue provision in subsection (j).
j. Exclusive venue for non-arbitrable matters. For any claim not subject to arbitration (including if you timely opt out, or if this arbitration agreement is found not to apply), you and EMG agree that the claim must be brought exclusively in the state or federal courts located in Leon County, Florida, and each party consents to the personal jurisdiction of and venue in those courts and waives any objection based on inconvenient forum.
k. Changes to this Section. If we make a material change to this Section 14, you may reject the change by emailing hello@evizionmediagroup.com within 30 days after the change is posted, in which case the most recent version of this Section 14 you accepted will continue to apply to disputes between you and EMG.
l. Severability. Except as stated in subsection (g), if any part of this Section 14 is found unenforceable, that part will be severed and the rest of this Section 14 will remain in full effect.
15. Changes to the Services or These Terms
We may change, suspend, or discontinue any part of the Services at any time. We may update these Terms from time to time by posting a new version with a new "Last Updated" date. Changes take effect when posted unless stated otherwise, subject to Section 14(k). If you keep using the Services after changes take effect, you accept the updated Terms.
16. General
- Entire agreement. These Terms, the Privacy Policy, and any written service agreement are the entire agreement between you and EMG about the Services.
- Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted and modified only as needed to make it enforceable, and the remaining provisions will stay in full force and effect.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not transfer these Terms without our written consent. We may assign these Terms at any time, including in connection with a merger, acquisition, or sale of assets.
- Survival. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, indemnity, governing law, and dispute resolution) will survive.
- Headings. Headings are for convenience only and do not affect interpretation.
